Klein Hornig Attorneys Present at ABA Boot Camp

From February 1-2, 2018, several Klein Hornig attorneys attended the ABA Forum on Affordable Housing and Community Development – 2018 Mid-Winter Boot Camp in Phoenix, AZ.

DC partner, Eric Herrmann participated in the panel entitled, “Section 8 Fundamentals and RAD 101.” Eric’s presentation focused on the Housing Choice Voucher Program and Project Based Vouchers, with an emphasis on deal structuring considerations and recent changes to the PBV program under HOTMA.

Boston associate, Andrew Gilmore participated on the panel entitled, “Introduction to HUD and its Housing Subsidies.” Andrew’s presentation focused on a number of HUD affordable housing and community development subsidy and grant programs, including the HOME Investment Partnerships (HOME) and Community Development Block Grant (CDBG) programs, housing development programs for special populations (Sections 202 and 811), programs for combatting homelessness in specific populations (HOPWA and HUD-VASH), the federal Housing Trust Fund, and the Choice Neighborhoods Initiative (CNI) grant program.

Klein Hornig Attorney Moderates ABA Panel

On Wednesday, October 25th, Klein Hornig associate Emily Blumberg moderated a teleconference for the ABA Forum on Affordable Housing and Community Development entitled, “The Impact of Increased Immigration Enforcement on Affordable Housing.”

The teleconference focused on federal laws that limit eligibility based on immigration status and how they interact with affordable housing programs and access. The panelists also took a look at the impact of immigration status in the context of relocation, VAWA and disaster assistance, including some recent developments. Finally, the program included a discussion of public housing authority perspectives on these issues.

Klein Hornig Attorneys Present at NLHA Seminar

On Friday, October 20th DC partners, Steve Niles and Eric Herrmann participated in a panel discussion entitled, “HAP Contract Issues and Opportunities” at the National Leased Housing Association’s Fall Seminar.

Steve moderated and Eric presented on the panel, which focused on transferring HAP contracts between projects, dividing HAP contracts for on-site redevelopment, Section 8 pass-through arrangements, and new requirements for HAP assignments and consolidations. Eric’s presentation also highlighted recent Klein Hornig transactions involving HAP transfers and bifurcations. Steve and Eric were joined on the panel by Walter Wynn, HUD’s Acting Director of, Field Asset Management and Program Administration, and Jennifer Larsen, HUD’s Acting Director of Asset Management and Counterparty Oversight.

Klein Hornig LLP Co-Sponsors Harvard Real Estate Alumni Organization Panel

On Thursday, September 28th, DC associate Eamon Lorincz moderated a panel entitled, “Strategies for the Preservation of Affordable Housing in the Global City”. The program focused on the increasing unaffordability of residential real estate in major U.S. cities and the state and local regulatory programs targeted to maintaining affordability, including in particular rent control (in New York) and the tenant opportunity to purchase act (TOPA) and inclusionary zoning (in DC). The panelists were Jim Campbell, a DC-based developer with extensive experience with affordable and market rate housing, Ellen McCarthy, a former director of the DC Office of Planning, and Cezary Podkul, an award-winning public-interest journalist based in New York.

Klein Hornig Attorneys Present at 2017 ABA Forum

From 24-26, 2017, Klein Hornig attorneys attended the 26th Annual ABA Forum on Affordable Housing and Community Development Law in Washington, DC.

Boston partner, Henry Korman participated on the panel entitled, “Targeted Populations in Affordable Housing Developments.” The panel focused on identity-based housing issues with specific emphasis on the legal concerns/constraints in developing housing targeted at specific groups including LGBT, gender-specific housing, intergenerational housing, and supportive housing for people with specific disabilities.

Fellow Boston partner, Katie Day participated on the panel entitled, “LIHTC Compliance after the Compliance Period: Once the Credits are Gone.” This panel focused on the compliance obligations of LIHTC projects during the “extended use period.” The panel also discussed policy considerations regarding long-term preservation of affordable LIHTC developments, the ability of state housing credit agencies to modify extended use agreements, and how the qualified contract fits within this policy.

Klein Hornig Attorney Moderates VAHCDO Panel

On Thursday, April 27th DC partner Aaron O’Toole moderated a panel sponsored by the Virginia Association of Housing and Community Development Officials (“VAHCDO”) entitled “Stretching Your Resources – 9%-4% Twining, Land Value, and More.”

The panelists discussed financing structures that maximize resources including an in-depth look at combining a 9% tax credit project with a tax-exempt bond and 4% tax credit project (9%-4% Twinning), the incentives for using such structures, their impact on VHDA QAP scoring, legal and financial complications, and business implications for managing the projects. The panel also looked at leveraging the value of land and creative uses of operating subsidy, soft debt, and local contributions.

Klein Hornig Attorney Presents on MACDC Panel

On Tuesday, April 4, 2017, Boston partner Katie Day presented on a panel sponsored by the Massachusetts Association of Community Development Corporations (MACDC) entitled, “Low-Income Housing Tax Credits – Partnership Agreements.”

The panel focused exclusively on the possible issues that can (and cannot) be negotiated in LIHTC Partnership Agreements. Klein Hornig Attorney Presents on ABA Panel

On March 1, 2017, DC associate, Emily Blumberg, presented on a panel sponsored by the American Bar Association Forum on Affordable Housing and Community Development entitled, “Fair Housing Developments in Treasury Department Programs and Low Income Housing Tax Credits: How Agencies’ Policy Moves May Impact Your Practice.”

The panel focused on the impact of recent policy issuances including the Treasury Department’s new rule implementing Title VI of the 1964 Civil Rights Act and notice of proposed rulemaking implementing Section 504 of the 1973 Rehabilitation Act, as well as the IRS notice on QAP projection selection preferences for projects located in qualified census tracts that are part of concerted community revitalization plans and procedure on QAP local approval requirements.

Other panelists included Nicole Clement, General Counsel at Rhode Island Housing, and Thomas Silverstein, Associate Counsel, Fair Housing and Community Development Project, Lawyers Committee for Civil Rights, Washington, DC. The panel was moderated by Amber Lee of the National Community Reinvestment Coalition.
