Klein Hornig is assisting an industry effort to roll back a recent change in HUD policy that has severely impacted RAD 2 conversions and other preservation efforts. The controversy involves the application of Davis-Bacon wage requirements to PBV contracts for “existing” housing projects.
Klein Hornig has joined forces with two other major law firms to send a legal memorandum to the Secretary of Housing and Urban Development, The Honorable Julian Castro, on September 11, 2014, arguing that the policy change violates the Administrative Procedures Act and is unsupported by statute.
We will keep our clients and friends advised; check back here for further information. Please contact Chris Hornig with any questions. To view the memorandum sent to Secretary Castro, click here.
